1. Introduction
These Online Sales Terms & Conditions (“Terms”) govern the sale of all products supplied through farmandtable.co.uk by FARM & TABLE LTD (“Farm & Table”, “we”, “our” or “us”).
By placing an order through our website, you confirm that you have read, understood and agree to be bound by these Terms.
These Terms should be read together with our Privacy Policy, Cookie Policy, Delivery Policy, Returns & Refund Policy and Website Terms of Use.
2. About Us
FARM & TABLE LTD is a company registered in England and Wales under Company Number 17261434.
Farm & Table operates an online marketplace supplying premium food products sourced from carefully selected producers and delivered throughout the United Kingdom.
3. Eligibility
By placing an order you confirm that:
- You are at least 18 years of age.
- You are legally capable of entering into a binding contract.
- The information you provide is accurate.
- You are authorised to use the chosen payment method.
4. Products
We make every effort to ensure product descriptions, photographs and pricing are accurate.
However:
- Images are for illustration purposes only.
- Product sizes and weights may vary naturally.
- Packaging may differ from photographs.
- Seasonal availability may affect supply.
- Products may occasionally be substituted with an equivalent item where appropriate, subject to applicable consumer law and any preferences you have indicated.
We reserve the right to amend product specifications where necessary without affecting your statutory rights.
5. Product Availability
All products are subject to availability.
Adding products to your basket does not reserve stock.
If an item becomes unavailable after your order has been placed, we may:
- Contact you to discuss alternatives.
- Partially fulfil the order.
- Delay dispatch.
- Issue a refund for unavailable items.
6. Pricing
All prices displayed on the website are shown in Pounds Sterling (£).
Prices include VAT where applicable.
Delivery charges, where applicable, will be displayed before payment.
Prices may change without notice, but confirmed orders will not be affected after acceptance except where an obvious pricing error has occurred.
7. Ordering
After placing an order you will receive an acknowledgement email.
This acknowledgement does not constitute acceptance of your order.
A legally binding contract is formed only when:
- Your order has been accepted; and
- We dispatch your products.
We reserve the right to refuse any order, including where:
- Payment cannot be authorised.
- Products are unavailable.
- Fraud is suspected.
- Pricing errors have occurred.
- Delivery is unavailable to your location.
- Legal or regulatory requirements prevent completion.
8. Payment
We accept payment using the methods displayed on our website.
Payment is normally authorised when the order is placed.
Products remain the property of FARM & TABLE LTD until payment has been received in full.
9. Delivery
Delivery information, estimated times and delivery areas are set out in our Delivery Policy.
Delivery dates are estimates only.
Delays may occasionally occur due to:
- Weather conditions.
- Supplier delays.
- Courier disruptions.
- Traffic conditions.
- Public holidays.
- Circumstances beyond our reasonable control.
We are not liable for delays outside our reasonable control.
10. Delivery Responsibilities, Failed Deliveries and Incorrect Customer Information
Customers are responsible for ensuring that all information supplied when placing an order is complete and accurate, including:
- The recipient's full name.
- The complete delivery address and postcode.
- Any flat, unit, building, access or gate information required to complete delivery.
- A valid telephone number.
- A valid email address.
- Any relevant delivery instructions.
Customers must check these details carefully before submitting an order.
10.1 Incorrect or Incomplete Delivery Information
FARM & TABLE LTD will not be responsible for a failed or delayed delivery where this results from incorrect, incomplete or misleading information supplied by the customer.
Where an order has already been dispatched, we may be unable to amend the delivery address or delivery instructions.
If a delivery cannot be completed because the customer has provided an incorrect or incomplete address, incorrect contact information, inadequate access instructions or other inaccurate information, the customer may be responsible for the reasonable costs and losses directly resulting from the failed delivery, subject always to applicable consumer law.
10.2 Customer Unavailable or Unable to Accept Delivery
The customer is responsible for ensuring that the delivery can be accepted at the delivery address on the agreed or notified delivery date.
Where delivery is attempted but cannot reasonably be completed because:
- No person is available to accept the delivery where acceptance is required;
- Access to the delivery address is unavailable;
- The recipient refuses delivery without lawful justification;
- The delivery information supplied by the customer is incorrect or incomplete; or
- Another circumstance within the customer's reasonable control prevents delivery,
we will make reasonable efforts, where practicable, to contact the customer using the telephone number and/or email address supplied with the order.
10.3 Failure to Respond
Where we or our delivery provider attempt to contact the customer regarding a delivery problem and the customer fails to respond within a reasonable period, we cannot guarantee that perishable products can be retained, stored, redelivered or remain suitable for consumption.
Because many FARM & TABLE products are fresh, chilled, frozen or otherwise perishable, it may not be possible to return them to stock or arrange a further delivery.
10.4 Perishable Goods Following Failed Delivery
Where a delivery fails for reasons attributable to the customer, including incorrect delivery details, failure to provide access, failure to accept delivery or failure to respond to reasonable attempts to contact them, FARM & TABLE LTD may be unable to offer a refund for perishable goods that can no longer safely or reasonably be resold.
Where appropriate, we may charge the customer the reasonable costs of:
- The original failed delivery;
- Returning or recovering the goods;
- Storage or handling;
- Disposal of perishable products; and
- Redelivery.
Any such charge or deduction will reflect the reasonable loss or costs actually incurred and will not affect any rights the customer has where the failed delivery was caused by FARM & TABLE LTD, our supplier or our delivery provider.
10.5 Redelivery
Where redelivery is possible following a failed delivery caused by circumstances attributable to the customer, FARM & TABLE LTD may require payment of an additional delivery charge before redelivery is arranged.
For fresh or perishable goods, redelivery of the original products may not be possible. Where replacement products are required because the original products can no longer safely be supplied following a customer-caused failed delivery, the customer may be required to place and pay for a new order.
10.6 Our Responsibility
Nothing in this section removes or restricts the customer's statutory rights.
Where delivery fails because of an error by FARM & TABLE LTD, our supplier or a delivery provider acting on our behalf, we will remain responsible in accordance with applicable consumer law.
11. Perishable Goods
Many of our products are perishable.
Customers should inspect deliveries promptly upon arrival.
Perishable products should be refrigerated or frozen immediately in accordance with any storage instructions supplied.
We cannot accept responsibility for deterioration resulting from:
- Failure to refrigerate products.
- Incorrect storage.
- Delayed opening after successful delivery.
- Failure to follow storage or cooking instructions.
12. Allergens
Food products may contain or have been prepared in environments where allergens are present.
Customers are responsible for reviewing product information before consumption.
If you have severe food allergies, please contact us before placing an order.
Nothing in these Terms limits your statutory rights regarding food safety.
13. Cancellations
Consumers may have cancellation rights under the Consumer Contracts Regulations 2013.
However, many food products supplied by Farm & Table are exempt from cancellation rights because they are liable to deteriorate or expire rapidly.
Where cancellation is possible, requests should be submitted as soon as possible before dispatch.
Once perishable goods have been dispatched, cancellation may no longer be possible.
14. Returns
Due to the nature of fresh and perishable food, returns are generally not accepted unless:
- Products are damaged.
- Products are faulty.
- Incorrect products have been supplied.
- Products fail to meet statutory consumer rights.
Customers should notify us as soon as reasonably practicable after delivery.
Photographs may be requested to assist with our investigation.
15. Refunds
Approved refunds will normally be processed using the original payment method.
Refunds may be offered where:
- Goods arrive damaged.
- Incorrect items are supplied.
- Products are unsafe.
- Deliveries cannot be completed due to our error.
- Your statutory consumer rights apply.
Further information is contained within our Returns & Refund Policy.
16. Product Quality
We work with trusted suppliers and producers to provide high-quality products.
If you believe a product does not meet the expected standard, please contact us promptly so that we may investigate and resolve the issue.
17. Promotions
From time to time we may offer:
- Promotional discounts.
- Voucher codes.
- Seasonal offers.
- Free delivery promotions.
- Competitions.
Promotions may be withdrawn or amended at any time unless otherwise stated.
Separate promotional terms may apply.
18. Limitation of Liability
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Breach of statutory consumer rights.
- Any liability that cannot lawfully be excluded.
Subject to the above, our total liability shall be limited to the purchase price of the relevant order.
We are not liable for indirect or consequential losses, loss of profits, business interruption or losses arising from events outside our reasonable control.
19. Intellectual Property
All website content, branding, logos, photographs, graphics and written materials remain the intellectual property of FARM & TABLE LTD or its licensors.
No content may be reproduced without prior written permission.
20. Privacy
Personal information will be processed in accordance with our Privacy Policy and applicable UK data protection legislation.
21. Force Majeure
We shall not be liable for delays or failures resulting from circumstances beyond our reasonable control, including:
- Severe weather.
- Flooding.
- Fire.
- Industrial action.
- Supplier failure.
- Utility outages.
- Government restrictions.
- Pandemic or epidemic.
- Cyber incidents.
Where possible, we will notify customers and minimise disruption.
22. Changes to these Terms
We reserve the right to amend these Terms at any time.
Updated Terms will be published on our website and will apply to future orders.
23. Governing Law
These Terms are governed by the laws of England and Wales.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in these Terms affects the statutory rights available to consumers under UK law.
